Lease: New/Revised Lease - How to Bring Existing Tenants into It

Legal Corner,

By Richard Marmor, Esq.
AZSA Legal & Legislative Chair

From time to time, AZSA revises its standardized lease. To avoid having tenants under different lease versions, we offer the attached PDF, describing how to bring all tenants under the most current revision. It is NOT necessary to require tenants to come into the office to sign a new lease. Rather, send a letter similar to the ones you receive from credit card companies when they change their cardholder agreements. As with the credit card, continued use constitutes acceptance of the terms. Included in the PDF below is suggested language for such a letter, letting tenants know that the terms of their lease are being upgraded and continued occupancy of their rented space demonstrates acceptance of the new terms.
